just went to top off the cololant in my 07 r6s and it was super dark and smelled like oil.
is that most likely head gasket or what?

usually oil in the coolant is a failure of the oil cooler or the seals to the oil cooler. I know the old f2 cbr bikes were bad about this but have not heard of the r6 bikes doing this .

More than likely its a head gasket. I have never seen the oil cooler seals go out. Not that it isn't a possibility, but I am going to go with head gasket needs to be replaced.

assuming its a blown headgasket, how bad it is to keep riding the bike?

Waterpump.
Oil and water are pumped around in there from the same pump(most bikes). If waterpump goes bad, oil gets mixed with coolant. If it would be headgasket, you'd have coolant in your oil more likely. I would start with waterpump but it can be either of them. Waterpump is easier to get to and for me it seems like a waterpump issue.
