looks slightly tweaked but not to bad, shouldn't have any issues with the tire hitting unless your rear suspension is going out (atleast i didn't have any issues on my 09 r6). looks like your subframe is pretty straight best way to tell is take it off the bike set it on the floor and see if it tilts one way or the other. its hard to repair, but can be done, but your better off just jumping on eBay and picking up another one or order an subframe from OnPoint or a company that makes one, since they are reinforced.
