\r\n \r\n Sparxx, what county? (I\'m in Suffolk)
\n
\nNow, an ACD is a dismissal after a set time (6 months, 1 year) and a "dismissal" is the same as "it never happened" so you should be good to go... They may ask you to write a letter explaining why you\'re a better person now.. but no biggie.
\n
\na couple things for you, stop by LongIslandFirearms.com our forums have all the info you\'ll need on getting your LICENSE, including the forms.
\n
\nYou\'ll need to start thinking of who to use for references - you\'ll need four, that are not family or police, that will sign a notarized letter saying you are \'of good moral character\'
\n
\nThen you fill out your forms, get fingerprinted, intervieewed, and dependign on county pay $100 to $600 in fees, and wait 6 months for your license.
\n
\nany questions hit me up!
\n

\r\n \r\n dont b suprised if u get declined
\n
\nconsidering you had a previous run in
\ndoesnt matter if it was a felony or not, they can decline you for pretty much whatever reason
\n
\nny is the worst state ever, they look for reasons to fail you and dont want to give permits out
\nand the process is about 8 months give or take
\ngood luck but dont hold your breath

first off, he\'s in Dutchess county, not NYC - Many of the upstate NY counties issue full-carry. (NYC you get a very strict \'to and from the range only, once a month\' restriction, Long Island/Nassau/Suffolk also restrict when but not quite so harsh)
\r\n
\r\nSo it\'s not so cut and dry that he\'ll get denied... Next, they can\'t just deny him \' because they want to\' they must have a valid reason.
\r\n
\r\nNext, NY is not \'the worst state ever\' by far - that goes to NJ, CA, MA... NJ you have to get an ID card from the state to be able to buy any gun...Carry? no one gets a carry. (I couldn\'t & I had connections way up in the DA office)
\r\n
\r\nThe process, under NYS Law, is the issuing agent must approve or deny in 6 months... Currently there is a backup in the mental health dept which they\'re using to delay things a bit... But as soon as someone challenges that delay it\'ll stop happening.
\r\n
\r\nThey don\'t "fail" you either, it\'s not a test. They don\'t necessarily "want" to deny you (yes, some do but that\'s personal not policy) They are investigating you to see if you qualify, and if you are of good moral character... If you were to "fail" it would be just like in school, it\'s YOU that failed yourself.
\r\n
\r\nIf they deny you just because they \'don\'t like you\' you can quickly take them to court, and you will get your license.
\r\n
\r\nIt\'s a simple thing to go to your local library and read the law for yourself... NY State CPL (Criminal Procedure Law) sections 265 and 400 are the weapons and licensing law.\r\n
