That being said, the environment that you are born into will give you a different perspective on life. Growing up right outside Boston I was in a gang when I was young, pulled some charges and then made the choice to get out of the lifestyle before the lifestyle took over my life. But they weren't. Some of them had better upbringing than I did, but still CHOSE that lifestyle. Others were born into it and moved on before I was smart enough to. I can tell you as I look back on how I was, I can see how lucky I am to not be dead or still in jail for some of the stupid shit I did for "respect" and "family". Just because you are in a Urban of Rural environment now, does not mean you have always been there, nor does it give you more or less credibility to argue one side or the other. We are all given choices based on what is around us. Sometimes there is less opportunity for some, but they are still there. |

No need to PM, it's all public record.
In NH at the time I had my annulment you had to wait 7 years after your sentence expired before you could petition the court if you were over the age of 21 when you committed the crime or 5 years if you were under 21. I had a 1-3 with 2 years probation/parole after and a suspended sentence after that for 2 years. I was under 21 when I committed my crimes so I could file for the annulment 5 years after the last part of the sentence ran out. So 3+2+2+ 5 years after conviction for the last offense. Turned out to be 14 years after the arrest in my case.
I filed the annulment myself. It's just a process, no need for a lawyer. I did my research on it at the public library but that was in the 90's. Depending on your state you should be able to do everything online. Just google your state for the RSA and tag annulment or expunge and you should be able to find the criteria. Also, you have to file for the annulment in the state you have the conviction in.

Just checked. NH is now 10 years for class A and 5 years for class B so the wait has gone up.

Depending on your state. In NH it was after the sentence ran out. So when my probation/parole ended, but to play it safe I waited till the suspended was no longer over my head. What state was or were the crimes in? All in one state, then you can do it there. If they were in different states, then you have to research those states and see what the criteria is for annulment/expungement. Different states call it different names. I know in NH, the record is cleared completely for the whleo offense. So the arrest, conviction and all sentencing is gone, even the mug show is supposed to be "sealed" from what I understand, unless you go to the federal level. The FBI and shit will always know.
But for all given purposed when I apply for gun purchases and permits and they ask have you ever been "arrested" for a felony, my legal right is to answer no. I got called on it by the local PD that I had my charges in when I applied for my CCW and they denied me it. When I went for the hearing the chief asked why I answered no when he had a file "right in front of him" with my arrest in it. I explained about the annulment and gave him the paperwork for it and kindly asked that he turn the record over to the county court because he wasn't supposed to have that anymore.... LOL
Permit came in the mail 3 days later. I have no clue where the file went.

You're from Brooklyn, are you a banger? Do you know bangers? (don't answer that BTW) Do you know cops? Do you consider any or all your friends? Kids that grew up next door from each other all their lives, reach a point where their paths change, some choose the gang life, others become cops, some move away, some stay in their neighborhood to make it better, others to make it worse. I never forget where I came from, nor do I look down on those that chose a different path that I did. We are still friends and brothers, that will never change.
The only tragedy in this story is that the uncle cared enough to take action, the kid didn't listen and that is tragic.
